Fisher Bren & Sheridan congratulates Brian Steffes, Ryan Gott and John Thomas for securing a tremendous verdict in defense of our civil engineer client, after a week-long jury trial in Federal Court in Bismarck, North Dakota. Plaintiff is a senior living apartment building owner, who alleged its building suffered flooding, among other issues. Plaintiff claimed that our civil engineer client designed the finished floor elevation too low and did not provide a proper drainage plan. Plaintiff alleged substantial drainage improvement repairs were required and that Plaintiff had lost over $1 million in rent and profits as a result. Plaintiff requested $2,059,295.71 from the jury. The jury returned a verdict finding our client only 5% negligent and responsible for only $12,966.25 in damages to Plaintiff.
